MyPlan - Terms and Conditions

1. MyPlan, the Indigenous Opportunities Policy management information system

1.1
MyPlan is the online system for managing the Indigenous Opportunities Policy.  MyPlan allows potential suppliers to draft, complete and submit Indigenous Australian Training, Employment and Supplier Plans and Implementation and Outcomes Reports for approval; and to access written Notification of Submission and Notification of Approval.  Organisations must first register with MyPlan at https://ecsn.gov.au/IOP/Account.aspx/Logon
1.2
Access to and use of MyPlan is subject to these terms and conditions. These terms and conditions shall be governed in accordance with the laws of the Commonwealth. Organisations must agree to comply with these terms and conditions and any applicable instructions, processes, procedures and recommendations as advised on MyPlan and the Indigenous Opportunities Policy Guidelines.
1.3
It is the responsibility of organisations to ensure that their infrastructure including operating system and browser revision levels meet the minimum standards as defined on MyPlan.  The Commonwealth does not take responsibility for any problems arising from organisations' infrastructure and/or Internet connectivity.
1.4
Organisations acknowledge that although the Commonwealth has implemented the security measures described on MyPlan, the Commonwealth does not warrant that unauthorised access to information and data transmitted via the Internet will not occur.
1.5
Organisations must inform themselves concerning all security measures and other aspects of the technical environment.  Organisations must make their own assessment of the MyPlan system prior to using it for any matter related to the Indigenous Opportunities Policy and no responsibility will be accepted by the Commonwealth arising in respect of any use or attempted use by any party of MyPlan.

2. Registered Organisations and Notices

2.1
In the event that the Indigenous Opportunities Policy administrator (IOP administrator) elects to vary or supplement the Indigenous Opportunities Policy, it will make reasonable efforts to inform organisations in accordance with this clause 2.
2.2
Organisations may be informed by notices and other information via www.employment.gov.au/Indigenous-Opportunities-Policy
2.3
Organisations that have registered on MyPlan will be notified via email of any variation or supplement to the Indigenous Opportunities Policy.  It is in the interest of organisations to ensure they have correctly recorded their contact details prior to submitting their Indigenous Australian Training, Employment and Supplier Plan. If organisations have not recorded their details correctly, they should amend their details and ensure that their details are updated.
2.4
The Commonwealth will accept no responsibility if an organisation fails to become aware of any variation or supplement to the Indigenous Opportunities Policy which would have been apparent from a visit to the www.employment.gov.au/Indigenous-Opportunities-Policy
2.5
Organisations are required to use the Indigenous Australian Training, Employment and Supplier Plan template provided on this site.

3. MyPlan Help Desk

3.1

4. Personal and Organisational Information

4.1
It is in the interest of users to register their details correctly, in particular prior to drafting an Indigenous Australian Training, Employment and Supplier Plan via MyPlan. The IOP administrator requires this information, including to notify an organisation of any variation or supplement to the Indigenous Opportunities Policy; and approval of its Indigenous Australian Training, Employment and Supplier Plan and Implementation and Outcomes Report.
4.2
The IOP administrator will treat any information provided by a user within the terms of its relevant privacy responsibilities (see MyPlan Privacy Statement).
4.3
In relation to the MyPlan website, personal information is collected to administer the Indigenous Opportunities Policy, including for correspondence, website security and audit purposes. The IOP administrator may disclose personal information to Commonwealth agencies; however no personal information will be disclosed to parties outside the Commonwealth.
4.4
In addition to this general Privacy Policy, where more detailed information is needed to explain our privacy practices, we publish separate privacy notices to describe how we will handle personal information that we collect. For example, where we ask you to provide personal information in relation to a particular program administered by the Department, we will provide you with a privacy notice which details our practices in relation to that particular program.
4.5
When an organisation submits an Indigenous Australian Training, Employment and Supplier Plan or an Implementation and Outcomes Report to the IOP administrator the organisation grants the Commonwealth a non-exclusive, royalty-free, perpetual licence to use, reproduce, adapt, exploit or publish that content.
4.6
The IOP administrator reserves the right to publish the status of an organisation's Indigenous Australian Training, Employment and Supplier Plan on employment.gov.au/indigenous-opportunities-policy in order to inform FMA Agencies of the status for contract management purposes.

5. Security Clauses

5.1
The MyPlan Administration User for an organisation is responsible for approving access to information pertaining to that organisation for other individuals who use MyPlan. Administration Users hold themselves to be a proper and authorised representative of that organisation in the business of approving access to information pertaining to that organisation for other individuals, submitting an Indigenous Australian Training, Employment and Supplier Plan and Implementation and Outcomes Reports.  If, subsequently, that person no longer has that right of authority, the person will send a request to the IOP administrator at iop@employment.gov.au to have such particulars removed or amended.
5.2
All persons who provide personal and organisational particulars within the MyPlan system hold themselves to be a proper and authorised representative of that organisation in relation to submitting an Indigenous Australian Training, Employment and Supplier Plan and an Implementation and Outcomes Report. If, subsequently, that person no longer has that right of authority, a proper and authorised representative of that organisation will send a request to the IOP administrator at iop@employment.gov.au to have such particulars removed or amended.
5.3
The Commonwealth maintains appropriate safeguards to ensure the security, integrity and privacy of personally identifiable information submitted to this site and periodically reviews and updates security measures in line with current technology.
5.4
Any account that has not been used to login to MyPlan for 12 months or more will be suspended. A notification email will be sent to the registered email address to advise of suspension.

6. Lodgement of Indigenous Australian Training, Employment and Supplier Plans and Implementation and Outcomes Reports

6.1
It is the responsibility of organisations to ensure that their infrastructure, including operating system and browser revision levels, meets minimum standards (see Hardware/Software Requirements). The Commonwealth takes no responsibility for any problems arising from organisations' infrastructure and/or Internet connectivity.
6.2
Organisations are required to use the Indigenous Australian Training, Employment and Supplier Plan template provided on this site. This may be a condition of compliance for having Indigenous Australian Training, Employment and Supplier Plan assessed. Where an organisation is unsure as to how to submit an Indigenous Australian Training, Employment and Supplier Plan, they should contact the MyPlan Help Desk.
6.3
Organisations are responsible for ensuring sufficient time for successful submission of an Indigenous Australian Training, Employment and Supplier Plan or Implementation and Outcomes Report. This includes time required for transmission and any problem analysis and resolution.
6.4
An on-screen receipt will be issued on successful submission of an Indigenous Australian Training, Employment and Supplier Plan or Implementation and Outcomes Report. It will include the time and date the Indigenous Australian Training, Employment and Supplier Plan or Implementation and Outcomes Report was received. Notification of Submission and Notification of Approval of an Indigenous Australian Training, Employment and Supplier Plan will be accessible via MyPlan. Organisations are required to print and store this receipt as proof of submission. If organisations fail to receive a receipt, they must immediately notify the MyPlan Help Desk.
