General Conditions of Use

Note: Please read these General Conditions of Use (Conditions of Use) carefully before using or accessing eCitizen.

Purpose of eCitizen

  1. eCitizen is designed to provide an Identity Self-Management tool for eCitizen users to maintain their own information. You may only use eCitizen for this purpose.

Use of eCitizen

  1. By using or accessing eCitizen, you (the user or intended user and any organisation you represent) accept and agree to comply with these Conditions of Use, and any applicable Specific Conditions of Use, as updated by the Commonwealth of Australia as represented by the Department of Employment and Workplace Relations (referred to in these Conditions of Use as ‘We’, ‘Us’ and ‘Our’) from time to time.
  2. You agree:
    1. to regularly check for updates to these Conditions of Use; and
    2. that when using or accessing eCitizen, you are agreeing to the Conditions of Use effective at that time.
  3. You must not provide any information through eCitizen that is false or misleading in and of itself or by reason of any information you omit, and if you do, action may be taken against you under the Criminal Code Act 1995.

Monitoring and Auditing

  1. We will monitor your use of eCitizen. This may include recording your domain name, server, address and the pages viewed by you through eCitizen. Where you have requested access to a secure part of eCitizen, your User ID will be recorded. Where you send a message or submit a form, your email address will be recorded.

Website Ownership

  1. eCitizen is owned, managed and maintained by Us.
  2. We have the right to:
    1. decide what information is displayed on eCitizen;
    2. review and update the Conditions of Use at any time;
    3. gather and use feedback from users of eCitizen to help improve and develop eCitizen; and
    4. where you do not comply with these Conditions of Use, refuse you future access to eCitizen as We see fit.

Compliance with laws

  1. You are responsible for abiding by Commonwealth, State and Territory laws when using eCitizen and any information available through eCitizen.

Intellectual Property Rights

  1. Unless otherwise specified, all intellectual property rights in all material displayed on eCitizen, and eCitizen itself, is owned by the Commonwealth.

Disclaimer

  1. We will use reasonable efforts to maintain the security of Our systems but we are not responsible for loss arising from any unauthorised access to your personal information.

Access and accuracy

  1. We will use reasonable efforts to ensure that eCitizen is available for you when required.
  2. We do not guarantee that:
    1. there will not be any interruptions while you are using eCitizen; or
    2. the information displayed on eCitizen is accurate, current or complete.
  3. We will take reasonable steps to ensure the security of Our systems and any personal information We hold and allow you reasonable access to your personal information to keep it accurate and current.

Security

  1. Only you may use your User ID and password to log on to eCitizen.
  2. You must keep your User ID and password secure and notify Us immediately if there is any unauthorised use of your account by any other person or any other breach of security.
    Please note: When using a public computer, you are encouraged to clear your browsing history after each use.

Indemnity

  1. You agree to indemnify (and keep indemnified) the Department of Employment and Workplace Relations, its officers, employees, and agents against any loss, liability or expense incurred by Us (including in relation to any claim made or action taken against Us) arising as a result of any wilful, unlawful or negligent act or omission by you, your officers, employees, agents or sub-contractors in connection with eCitizen.

Privacy

  1. We collect personal information about you through eCitizen, and in some cases, through the Employment Services System, for the purposes of verifying your identity, deciding whether to provide you with access to relevant parts of Our IT systems, and for monitoring and security purposes. We cannot provide access to Our IT systems if relevant personal information is not provided by you.
  2. To the extent that your eCitizen account was initiated by a third party (for example, by an Employment Provider), your personal information collected through eCitizen will be passed on to that third party. We will not pass on your personal information to overseas recipients.
  3. The privacy of eCitizen users is important to Us. Our Privacy Policy contains more information about the way in which We manage your personal information and how you may access and correct your personal information held by us. It also contains information about how you can complain about a breach of the Australian Privacy Principles, and how We will deal with such a complaint.
